1. Who we are

Siliconear ("Siliconear", "we", "us", "our") operates the website siliconear.com and sells the products listed on it. The store is operated from Spain and ships to customers in the United States.

2. Accepting these terms

By browsing this site or placing an order, you agree to these Terms. If you do not agree with them, please do not use the site. We may update these Terms at any time; the version published here when you place your order is the one that applies to that order.

3. Who can buy

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that the payment method you use is yours and that the information you give us is accurate and complete.

4. This is not a medical device

Siliconear products are personal comfort accessories. They are not medical devices. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, and nothing on this site is medical advice.

Do not use the product if you have an ear infection, a perforated eardrum, ear tubes, or if you have had ear surgery. Stop using it if you feel pain, and consult a qualified healthcare professional if your symptoms persist or worsen. Read the Safety & use guide before first use.

5. Products, prices and availability

All prices are shown in US dollars (USD) and exclude any duties or local taxes that may apply. We try to describe and picture our products accurately, but colours can vary between screens and small design changes can occur between production batches.

Prices and availability can change without notice. We may limit or cancel quantities purchased per person, per household or per order. If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund you in full, even if the order has already been confirmed.

6. Orders and payment

Your order is an offer to buy. We accept it when we send you an order confirmation email. Payment is taken at checkout through Shopify's payment providers; we never see or store your full card details.

We may refuse or cancel an order that appears fraudulent, that breaks these Terms, or that we cannot fulfil. If we cancel an order you have already paid for, you get a full refund.

7. Shipping and delivery

Shipping terms, costs and timeframes are set out on our Shipping page and form part of these Terms. Delivery estimates are estimates, not guarantees, and can be affected by carriers, customs and weather.

8. Returns and refunds

Our Returns & refunds policy forms part of these Terms. Please read it before ordering, in particular the hygiene rules that apply to a product used in the ear.

9. Reviews and anything you post

If you send us a review, photo or comment, you keep ownership of it but give us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our products and marketing. You confirm the content is yours, that it is truthful, and that it does not infringe anyone else's rights. We may remove content that is unlawful, abusive or misleading.

10. Acceptable use

Do not use this site to break the law, to interfere with its operation or security, to scrape it systematically, to impersonate anyone, or to upload malicious code. We may suspend access if you do.

11. Intellectual property

The Siliconear name, logo, site design, text, graphics and photographs are owned by us or licensed to us and are protected by intellectual property law. You may not copy, reproduce or use them commercially without our written permission.

12. Links to other sites

Where we link to a third-party site, we do so for convenience. We do not control those sites and are not responsible for their content, products or privacy practices.

13. Disclaimer of warranties

The site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim connected with a product or with this site is limited to the amount you paid for the product in question. We are not liable for indirect, incidental, special or consequential losses, including lost profits or lost data.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by our negligence, or for fraud.

15. Indemnity

You agree to indemnify us against any claim arising from your breach of these Terms, your misuse of a product, or your violation of any law or third-party right.

16. Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Nothing here removes the protection of any mandatory consumer law that applies where you live, including in your US state of residence.

17. Severability

If a court finds any part of these Terms unenforceable, the rest stays in force.
